These Terms and Conditions apply to all Guests, and it is the responsibility of the person making the booking to ensure that these terms are understood and complied with. The Owners reserve the right to cancel a booking or repossess the Holiday accommodation without compensation or refund should Guests not comply with the Terms and Conditions outlined below.
The Guests shall be entitled to occupy the property for holiday purposes only and this agreement shall not confer on the Guests any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded Tenancy.
Bookings can only be made by persons over the age of 18 years. A booking is a legal contract and is accepted as such when the deposit has been paid and you receive written confirmation of that from us. Please check that the details are correct and advise if there are any errors.
2 Pricing structure
The price for a holiday shall be taken from the price range on the date of the start of the holiday, even if the letting duration spans a published price change.
A booking deposit of £100.00 is required, with the balance payable 8 weeks in advance of the start of the holiday. If booking within 8 weeks of holiday, then the whole cost is required in full. Please note that if the full balance is not received by the due date you may lose the deposit.
The price includes all reasonable heating and electricity costs, bed linen, towels, starter pack for bathroom & kitchen and open fire. A welcome tray of tea coffee biscuits and milk on arrival.
In the event of your cancellation, deposits are normally non-refundable. If you have to cancel less than 6 weeks prior to the holiday start we will endeavour to re-let the cottage and if successful we will return the deposit less £40 admin fee. If unsuccessful in re-letting the accommodation we reserve the right to charge you the full rental fee, and strongly recommend that you take out a cancellation insurance policy against this or other such eventualities i.e. severe weather, illness etc.
In the event of your accommodation becoming unavailable due to circumstances out of our control, every effort will be made to provide alternative accommodation at a holiday cottage nearby or a complete refund will be paid including the deposit. Our liability would not extend beyond this refund.
5 The owners
The owners do not accept responsibility for any breakdown in public or local supplies including Internet speed, water, electricity or gas nor any claims against inconvenience caused by such incidences, or by building or maintenance work deemed necessary.
In the case of any breakdown, Guests are asked to notify the owners immediately who will endeavour, in conjunction with the service company concerned to correct the fault as soon as reasonably possible.
The owners retain the right to repossess the holiday accommodation if it is reasonably believed that damage or nuisance has been caused. Under these circumstances no refund will be given.
The property is monitored externally.
We do not allow smoking anywhere inside the cottage.
We hope your stay will be enjoyable, however if there is any reason to be dissatisfied please make these known at the time to the owners and we will try to address them during your stay. Complaints raised after the Guest has departed without having raised them at the time will be considered on individual merit.
Your Cottage will be available from 4 pm on the day of arrival. Please text or call me 15 minutes before arrival. To enable me to meet and greet you at the property.
Please vacate the cottage by 10 am on the day of departure to allow us time to make ready for the next Guests. It would be appreciated if a text could be sent on 07887 777799 if leaving earlier.
11 Number of Guests (2 max)
The number of Guests occupying the cottage must not exceed the maximum occupancy stated on the booking form.
The conduct of all Guests must be such as not to cause a nuisance or damage to any property.
We reserve the right to terminate the stay of any Guests without refund, if these conditions are not observed.
12 Damages, Breakages and Cleaning.
We do not accept any responsibility /liability for loss, injury or damage to Guests' personal effects or property or expenses of any kind sustained by any member of the party whilst staying at Burnswark Holiday Cottage. Please take care of yourself and the accommodation, you are responsible and liable for any breakages, damages or excess cleaning which you cause to the accommodation or it's contents. Please report any damage or breakages as soon as they occur, we do not normally charge for minor breakages, but reserve the right to charge you for replacement, repair or making good if the damage or breakage is significant.
Please note that consequential costs may be incurred where it is not possible to repair or clean the Cottage prior to the arrival of the next Guests who subsequently demands compensation from us.
Your attention is drawn to these terms for ease of reference before you book so that you enjoy your stay in comfort.
Insurance Information for Guests
Insurance: Due to FSA rules we are unable to provide or sell cancellation insurance.
However, we strongly recommend quests seek some form of cancellation and or travel cover as cancellation of the holiday will mean loss of either deposit or the full amount, if paid.
Further where the holiday is not fully paid, depending on the time the cancellation (see clause 4) is made the guest may well be liable for any balance due.
Guests should be sure that any insurance taken out covers all eventualities including travel and road conditions as the owners are not liable for circumstances that may prevent you accessing the property.
